Court denies appeal of circus family assault suit

WASHINGTON (AP) ? A court has turned down an appeal from the sister of the CEO of the Ringling Bros. and Barnum & Bailey circus who claimed her estranged brother had her assaulted by private security guards.

A three-judge panel of the U.S. Court of Appeals for the District of Columbia Tuesday called her appeal "without merit and easily rejected."

Karen Feld lost her $110 million lawsuit last year against circus CEO Kenneth Feld. She had claimed that Kenneth Feld's private security guards assaulted her when they threw her out of their late aunt's shiva (a Jewish mourning ritual) held at a condo owned by Kenneth Feld.

The appeals court rejected Karen Feld's argument that Kenneth Feld was not entitled to use force to remove her from the building.

Ohio woman attempts to break into jail

An allegedly?drunken Ohio woman baffled local law enforcement officers when she tried to break into a county jail and demanded that she be arrested, NBC station WLWT in?Cincinnati?reported.?

Officials said Tiffany Hurd was seen attemping to get in the jail by climbing a barb wire fence.

Tiffany Hurd, 36, went to the Butler County Jail Sunday Morning when deputies saw her attempting to climb over a barbed-wire fence. She?was advised to leave by staff and refused?and said, "I want to be arrested."

A corrections officer saw Hurd lying near the fence earlier as he was?leaving?the jail after finishing his shift. Deputies?advised her to leave,?but she refused, saying,?"I want to be arrested."

The deputies obliged and Hurd was charged with disorderly conduct and criminal trespassing. She's being held at the Butler County Jail, the station reported.

TJ, 34, is the son of Tito Jackson. TJ Jackson was placed as a temporary guardian by a judge while Katherine Jackson was vacationing in a spa in Arizona.

During Jackson's time in Arizona, she reportedly had no contact with her grandchildren. She later claimed she was taking a break and had voluntarily cut off communication.

Jackson told ABC News in a televised statement that the court ruling was "based on a bunch of lies" and she was "devastated" the children were taken away from her.

According to Michael Jackson's estate, he was $500 million in the hole when he died in 2009 but he has nearly earned that much back posthumously. From November 2010-December 2011, the trust gave the kids an allowance of $2,139,194. Of that allowance, over $400,000 was spent on residential expenses at Katherine Jackson's Calabasas, Calif. home, more than $650,000 on security and more than $53,000 on utilities.

Cavendish hails 'dream team' as hosts look for first gold

Tour de France sprint king Mark Cavendish believes a 'dream' British cycling team can notch what could be the hosts' first gold medal of the Games at the Olympic men's road race on Saturday.

Only six days after Cavendish played a role in Bradley Wiggins' historic yellow jersey triumph, the race's 23-times stage winner starts as the favourite for the 250 km men's road race on the opening day of competition.

A host of challengers like Germany's Andre Greipel and Slovakian Peter Sagan stand in his way, but Cavendish believes Britain's five-man team have the edge.

"It's the dream team," said the 27-year-old from the Isle of Man. "If we wanted to win this bike race we couldn't be in a better situation team-wise."

Britain will line up with a five-man team notably including Wiggins and Scot David Millar armed with a plan to deliver Cavendish to the home straight in the perfect position for a bunch sprint.

If the plan comes together, the 'Manx Missile' -- going on his recent form -- will be hard to beat.

Crowned the world champion in 2011, when he beat Australian Matt Goss to the rainbow jersey in Copenhagen, Cavendish put some doubts over his form early in the Tour de France to bed with two, stunning late wins in the race.

Wiggins affirmed that any concerns Cavendish may ultimately pay for completing both the Giro d'Italia and the Tour in the last two months are well wide of the mark.

"We've got the fastest man in the world and I guess it's for other people to combat that," said Wiggins.

When it comes to tactics, the road race, however, will be hard to predict.

It starts and finishes on the flat of The Mall within sight of Buckingham Palace, but with a circuit which featuring the climb of Box Hill and will be raced nine times Britain will have to be tactically astute.

Australia said they won't just be looking to put Goss in a bunch sprint.

"Most of the traditional cycling nations don't want a sprint because they've got very limited chances of a medal, I expect the race to be aggressive early; otherwise it just plays into the hands of the Poms (British)," said Australia boss Matt White.

"We've got a team that can afford to be aggressive. If it doesn't work out then we've always got Gossy for the sprint, we can work both ways."

Like Britain with Wiggins, Australia's team of Goss, Simon Gerrans, Stuart O'Grady, Cadel Evans and Michael Rogers has been labelled the "best" ever by O'Grady, who is competing in his sixth Olympics.

"This is the best team Australia has ever had going into an Olympic road race," said O'Grady.

Milan-SanRemo champion Gerrans, meanwhile believes believes one of their potential advantages is the pressure factor on the hosts.

"Yeah, definitely, and the fact they are going in with the current world champion (Cavendish) and Tour de France champion (Wiggins) as well, that's obviously attracting a lot of attention," said Gerrans.

"In the past they have seemed to handle the pressure fairly well, but I don't think they have ever had pressure like this before."

As well as Cavendish and Goss there's Sagan, Greipel, and Belgian pair Tom Boonen and Philippe Gilbert.

Sagan, who won three stages at the Tour de France including the sprinters' green jersey, stands out because he will not to have the full five-man team at his disposal given Slovakia's comparatively lower ranking

And while he has been given a positive appraisal from world cycling chief Pat McQuaid, the Irishman said a Cavendish win would not go amiss.

"I want to see the best win, whoever it might be," said McQuaid, the International Cycling Union (UCI) president.

" ... But I have to show a certain bias. Mark Cavendish coming up that finishing straight would just be the icing on the cake for the first gold medal of the Olympics."

Obama's last campaign taking a nostalgic detour

WASHINGTON (AP) ? Barack Obama reminisces about taking a wrong turn and getting lost, about fumbling to fold up a map and about dashing to Kinko's to copy campaign fliers.

The president's re-election campaign is sounding like a nostalgia tour.

His speeches stroll through elections past, serving up fond memories of running as a political unknown. He also reminds voters that, win or lose, this will be his last campaign after 13 appearances on the ballot since 1996.

These are not the casual ad-libs of a candidate suddenly turning wistful. Rather, it's a rhetorical device designed to transport Obama back to the days when he was the kind of ordinary guy voters felt they could relate to, long before he rode in limousines and flew Air Force One.

5 Home-Based Business Software Needs

As a self-employed person working out of my home, I?ve bought a ton of software applications. Most proved unnecessary while a few applications proved to be invaluable.

The following is a list of my 5 favorite business software applications for running my home business:

1. Microsoft Office

I know I?ll take some heat for this one, but I like Microsoft office. Yes, it?s expensive. Yes, there are free alternatives such as Google Docs and Open Office. However, I?m accustomed to MS Office, especially Word, Excel, Outlook and PowerPoint. I use all 4 daily and like them.

2. Web-Based Back-Up Software

About 2 years ago my laptop crashed and burned. The data was not recoverable. I lost a ton of information. And no, I had not backed up my data.

As soon as I bought my new laptop, I signed up for an online web-based data backup service. I knew from experience that I would not take the time to manually back up my files onto a CD, hard drive or DVD. Therefore, a web-based back-up service is ideal.

The service I use backs up my data automatically every day. All my data is stored on their server which means I don?t have to worry about it. If my current laptop crashes and burns, I just have to download all my data on a new computer.

3. Anti-virus software

I?ve always used anti-virus software so I?m not sure what would happen to a computer without it. If you run a business, and much of your business is on your computer, anti-virus software is critically important.

4. Website Software

Home Based Businesses Some home-business operators rely on a website designer for the website. Not me. I build and run my own website using WordPress. I love WordPress, but it?s no the only game in town. The important thing, in my view, if you?re starting out and have limited resources and need new business, is to get website building software.

There?s very simple-to-use online website builders, WordPress, and Joomla ? all three of which anyone can learn to use and build a great website fairly quickly.

I blog regularly for my business so having blogging-based website software is invaluable. Whether it?s a small brochure site or a large and dynamic site, most small businesses need a site and being able to add content and manage the site is a terrific thing for any small business owner to know.

Even if you don?t want the hassle of dealing with your own site, if you know what?s involved, it?s much easier hiring the right people to take care of it for you.

5. Fireworks or Photoshop by Adobe

If you do any work with images for marketing purposes, having Fireworks and/or Photoshop is a wonderful software asset. Almost every day I go into one or the other to tweak images used in my online marketing. They?re also terrific for creating free guide covers as informational give-aways which any business can do to generate leads.

Again, you can hire people to handle images for marketing, but once you know the basics, it?s easy to tweak your own images to come up with basic marketing images. It?s fast and costs nothing. I?m not saying not to hire pros for more complex work, but being able to deal with your own images for your own website and some marketing materials can save you a ton of time and money in the long run. Plus, it?s fun and can be used for personal images as well.

No business is the same; therefore each business may have unique software needs. Moreover, each business owner is unique and therefore software needs may vary.

Industry-specific software

For example, in some industries, there is industry-specific software to help manage businesses. There?s fitness center software, law firm management software, medical practice software, etc. If you?re in an industry that has specifically designed software, it may be worthwhile investing in a robust software application to run your business.

Bookkeeping software

If you do your own books, you might want bookkeeping software to save time and money. I use spreadsheets to track my revenue and expenses and then provide that data to an accountant. Therefore I don?t use bookkeeping software, but I?m sure it could be handy for me if I were inclined to learn it.

Communications software

I never took to Skype. I have an account, but don?t use it much (only when the other person needs to use Skype). However, more and more business owners are relying on Skype-type communications software to handle communications needs. If you spend a great deal of time communicating and your cell phone bills are huge, Skype could be a good solution.

Voice Recognition software

I?m fairly impressed with the voice recognition software that?s included with Windows 7. I?ve used it somewhat; although I prefer typing (I type fast and tend to think better typing out of habit). However, if you need to generate a lot of the written word and your typing isn?t up to speed, voice recognition software may be the answer. It takes time to learn and train the software, but many people these days are able to get a lot more done with it.

Why did I split up this article into 2 parts?

Because the first 5 suggested software applications for home-based businesses is the actual software I have and use. The following 4 suggestions may be worthwhile, but I don?t have any of it.

There?s certainly a lot more types of software out there. I?ve bought plenty of it. However, when resources are tight, it?s important to buy only that which actually moves your business forward. A lot of software is more a distraction than a productivity tool.

Therefore, assess each software before purchase with a mind toward whether it will actually make you and your business more productive or simply be a waste of time and money.

Now that all the big handset makers have put in their quarterly sales figures, Strategy Analytics has done the number crunching for an overall picture of what happened in the mobile market. But smartphones, still at a less mature state, are selling much better: collectively, shipments (which equals sales in SA's book) grew by 32% in the quarter, the analysts said, with Samsung and Apple leading the way with over half the global market between them. That sounds like a good-news story for smartphones, except when you understand that 32% growth (146.1 million units total in Q2)?is actually the slowest the smartphone market has expanded in three years. Andreessen Horowitz Keeps Eating The Software World With $11.2 Million Investment In JavaScript Framework Company Meteor

Meteor, the company behind an application development framework of the same name, today announced $11.2 series A funding from Andreessen Horowitz, with Matrix Partners also contributing. The investment follows Andreeseen Horowitz' record breaking $100 million investment in Github. The Meteor framework is free and open source and can be used for creating rich, Google Docs style applications in the browser. The developer preview launched last April. The company plans to monetize the product by selling enterprise support and services.
