I have an e-commerce business that sells various electronic goods by dropshipping. It is currently filled with products, but I have decided to change suppliers and overhaul the total inventory of the business. The new supplier provides photos and all necessary information. The winning bidder will take all the new data and enter into the Magento system of the existing website. The number of products will be about 100 or so.

The winning bidder must have strong experience with Magento and wth internet marketing. They will be fast and efficient and have good attention to detail.

Additionally, I would like the winning bidder to do some maintenance and a clean-up of the systems to make the business more efficient and smoother to run.

No God in football? Cheerleaders defend biblical banners

A Texas school district's ban of Christian "run-through" banners at football games angers students. KBMT's Augustin Garfias reports.

A group of Texas high school cheerleaders is at the center of a spat over religious speech after the school district told them they had to stop using Christian-themed banners at school football games.

The large signs, carried onto the field at Kountze High School, included messages such as "I can do all things through Christ which strengthens me" and "But thanks be to God which gives us victory through our Lord Jesus Christ," according to a report by NBC Dallas-Fort Worth.

Kevin Weldon, superintendent of the Kountze school district, about 85 miles northeast of Houston,?informed the cheerleaders? parents Tuesday that the religious banners would not be allowed, the station reported.

Weldon's decision set off a tempest in the community of about 21,000, but he told the Houston Chronicle that it was based on 2001 Supreme Court decision that keeps religion out of public schools.

"The decision I made is not my personal opinion," Weldon told the Chronicle earlier this week. "I'm a Christian. This puts me between a rock and a hard place."

Weldon reportedly made the decision after receiving a letter of complaint from the Freedom From Religion Foundation, a national nonprofit organization that advocates separation of church and state, the Christian Post reported.

But the cheerleaders scored a partial victory on Thursday, when a judge granted a temporary restraining order on enforcement of the ban after parents of the cheerleaders filed a discrimination suit earlier in the week, the Houston Chronicle reported.

Under the injunction, the cheerleaders will be allowed to use the Biblical banners at games at least until an Oct. 4 hearing.

The nonprofit Liberty Institute, which is representing the cheerleaders'?parents, argues that it is unconstitutional to censor religious speech in this manner, the Post said.

The Texas Association of School Boards would not discuss its confidential conversations with Weldon, who had sought the organization's advice prior to banning the religious banners, but issued a statement on the case:

"The federal court guidance... draws a distinction between private student speech, including written messages, which enjoys free speech protection under the First Amendment, and school-sponsored speech, which must conform to the Establishment Clause by not endorsing, coercing, or favoring religion,? Joy Baskin,?the association's director of legal services, said in the statement.

"Whether the display of a religious message by cheerleaders on the field at a high school football game constituted private or school-sponsored speech depends on a number of factors which must be weighed by the district, its counsel, and in this instance, the judge considering the case," Baskin said.

Cheerleader Macy Matthews, 15, argued that no school money was used and the signs weren't made on school property, so they should be allowed. She said she didn't anticipate the ban.

"It was upsetting because it's what motivated the boys each week," Matthews told the Chronicle. "I was shocked, really. I didn't understand why it would be a problem."

A Facebook page?promoting the cheerleaders' cause had garnered more than 39,000?members by Friday.

Humans were already recycling 13,000 years ago, burnt artifacts show

ScienceDaily (Sep. 20, 2012) ? A study at the Universitat Rovira i Virgili and the Catalan Institute of Human Paleoecology and Social Evolution (IPHES) reveals that humans from the Upper Palaeolithic Age recycled their stone artefacts to be put to other uses. The study is based on burnt artefacts found in the Mol? del Salt site in Tarragona, Spain.

The recycling of stone tools during Prehistoric times has hardly been dealt with due to the difficulties in verifying such practices in archaeological records. Nonetheless, it is possible to find some evidence, as demonstrated in a study published in the ?Journal of Archaeological Science?.

?In order to identify the recycling, it is necessary to differentiate the two stages of the manipulation sequence of an object: the moment before it is altered and the moment after. The two are separated by an interval in which the artefact has undergone some form of alteration. This is the first time a systematic study of this type has been performed,? as explained to SINC by Manuel Vaquero, researcher at the Universitat Rovira i Virgili.

The archaeologists found a high percentage of burnt remains in the Mol? del Salt site (Tarragona), which date back to the end of the Upper Palaeolithic Age some 13,000 years ago. The expert ensures that ?we chose these burnt artefacts because they can tell us in a very simple way whether they have been modified after being exposed to fire.?

The results indicate that the recycling of tools was normal during the Upper Palaeolithic Age. However, this practice is not documented in the same way as other types of artefacts. The use of recycled tools was more common for domestic activities and seems to be associated with immediate needs.

Recycling domestic tools

Recycling is linked to expedited behaviour, which means simply shaped and quickly available tools as and when the need arises. Tools used for hunting, like projectile points for instance, were almost never made from recycled artefacts. In contrast, double artefacts (those that combine two tools within the same item) were recycled more often.

?This indicates that a large part of these tools were not conceived from the outset as double artefacts but a single tool was made first and a second was added later when the artefact was recycled,? outlines the researcher. The history of the artefacts and the sequence of changes that they have undergone over time are fundamental in understanding their final morphology.

According to Vaquero, ?in terms of the objects, this is mostly important from a cultural value point of view, especially in periods like the Upper Palaeolithic Age, in which it is thought that the sharper the object the sharper the mind.?

Sustainable practices with natural resources

Recycling could have been determinant in hunter-gatherer populations during the Palaeolithic Age if we consider the behaviour of current indigenous populations nowadays.

?It bears economic importance too, since it would have increased the availability of lithic resources, especially during times of scarcity. In addition, it is a relevant factor for interpreting sites because they become not just places to live but also places of resource provision,? states the researcher.

Reusing resources meant that these humans did not have to move around to find raw materials to make their tools, a task that could have taken them far away from camp. ?They would simply take an artefact abandoned by those groups who previously inhabited the site.?

Vaquero and the team believe that this practice needs to be borne in mind when analysing the site. ?Those populating these areas could have moved objects from where they were originally located. They even could have dug up or removed sediments in search of tools,? highlights the researcher.

SLC house fire displaces family of three | News | Salt Lake City ...

Firefighters responded to a house fire in Salt Lake City Wednesday morning.

No one was in the home, located at 1307 S. 300 West, when the fire started just before 9:30 a.m. A neighbor called it in to authorities.

Jasen Asay, with the Salt Lake City Fire Department, said there was smoke and flames coming from the basement when crews arrived.

A witness to the fire jumped into action before crews arrived at the home.

?[I] grabbed the garden hose, opened it up and turned on and put it down it the little window there,? said Richard Chacon, a witness. ?A lot of smoke, we were going to go in the back door, but there was too much smoke.?

Six fire engines responded to the blaze and the fire was out in about 15 minutes.

Investigators are working to determine the cause of fire.

Fire crews said the family that lives at the home will not be able to stay there Wednesday evening because of the smoke damage. They are working wit the Red Cross.

NEW YORK (AP) ? Rebuking Mitt Romney, President Barack Obama said Tuesday that Americans are not "victims" and that voters want to make sure that their president is "not writing off big chunks of the country."

Obama's remarks came after a secretly taped and newly released video showed the Republican presidential nominee describing "47 percent of the people" as Obama supporters who depend on government and believe they are victims.

"My expectation is that if you want to be president, you have to work for everyone, not just for some," Obama said in a taping of the "Late Show" with David Letterman.

It was Obama's first response to the Romney video, which roiled Romney's campaign and put him on the defensive about his views about nearly half the nation. The president appeared on the TV show before a night of fundraising in New York City.

In the video, taken during a May fundraiser and posted online Monday, Romney said it is not his job "to worry about those people." He was referring to what he called Obama's locked-in supporters who believe they are "entitled to health care, to food, to housing, to you name it."

Romney has since said he made his point inelegantly in trying to describe differing visions for the nation.

"There are not a lot of people out there who think they are victims" or simply entitled, Obama said.

Obama said people understand that the presidential candidates will make mistakes on the campaign trail. He said that includes one he regrets from 2008, when audio from one of his own private fundraisers had him saying that some residents of depressed rural areas get bitter and "cling to guns or religion or antipathy to people who aren't like them."

Having said that, Obama added: "One thing I've learned as president is that you represent the entire country."

The president and Letterman also bantered over lighter subjects, with Obama joking about the Florida pizza restaurant owner who lifted him off the ground in a bear hug last week. "I think he fixed something in my back," Obama said.

The two men exchanged compliments on their appearances.

"You look good," Obama said.

"You haven't seen me naked," Letterman said.

Obama replied: "We're going to keep it that way."

Later, Obama spoke to about 200 people at a fundraiser at the Waldorf Astoria Hotel. Tickets for the event started at $12,500 per family.

He ended the night at a fundraiser hosted by Beyonce and her husband Jay-Z at the rap mogul's 40/40 Club.

About 100 supporters paid $40,000 per person to attend the party, which was expected to raise about $4 million for Obama's campaign and Democratic Party organizations.

NOLA Brewing Brings Beer Back Home to New Orleans - invadeNOLA

How could a city like New Orleans ? so known for partying, food, and drink ? not have its own notable locally brewed beer? Seems unnatural, right? This was not always the case.

New Orleans was once a Southern beer production capital, rather than just its consumption capital. For years, the locally-brewed Jax and Dixie beers were favorites across the state, and even around the country. But, over time, both NOLA beer stalwarts disappeared off shelves and taps due to financial and natural disasters ? Jax due to bankruptcy and Dixie to Hurricane Katrina. Though Dixie?s Mid-City brewery was flooded, the label has managed a modest comeback years later thanks to outside breweries, like Heiner Brau in Covington and others nationwide, taking on a limited production to help keep it alive.

After the storm, a void was left in the beer production in New Orleans. Though a few microbreweries across the state either started or increased production in that time, Louisiana?s major city ? the home of Mardi Gras and Bourbon Street, Hurricanes and Hand Grenades ? was left rather dry.

This beer deficiency was not lost on locals, and it certainly did not go unnoticed by Kirk Coco. While serving in the Navy and deployed in the Arabian Gulf, Coco, a native of New Orleans, watched from afar the effect Hurricane Katrina was taking on his hometown. He knew when he returned he would contribute to the rebuilding process by starting a business and help develop commerce in the city.

But, what business to start? The answer to this question was found by asking himself another question, ?Why doesn?t New Orleans have several great local micro-breweries like Portland or Seattle to offer a variety of beer to a city full of brewing history??

Enter Peter Caddoo, a highly skilled and well-respected brewmaster, who is a significant figure in the city?s rich beer history as a former brewmaster at Dixie Beer. After meeting through mutual friends in 2007, the two ventured out to the Craft Brewer?s Conference in San Diego to learn the ins-and-outs of business. During this time, with the company still very much in its infancy, Coco and Cadoo met the third key figure in the NOLA Brewing family ? Dylan Lintern ? and together they put the brewery together on Tchoupitoulas. Not long after, Melanie Knepp joined the team and NOLA Brewing got rolling in earnest.

Throughout the process, one key element remained constant ? the importance of New Orleans? location and culture. New Orleans has a uniqueness and an openness unparalleled in major American cities and the NOLA Brewing team certainly wanted that to come through in their product. From the individual brew names (Hopitoulas, 7thStreet Wheat, Flambeu Red, Irish Channel Stout, etc.) to the fleur-di-lis-topped wrought iron fence that encircles the brewery, NOLA Brewing honors its hometown city, and in turn, the locals have graciously welcomed them. Though NOLA is the heart, they have not limited themselves to just the local market. Like all craft breweries, expansion is slow, especially when the demand locally is so high. But, in a relatively short time, NOLA Brewing has expanded into Alabama and the Florida panhandle. Through craft brew festivals, magazines, etc., NOLA Brewing?s presence has increased and distributors are constantly inquiring about their product. Further expansion is planned soon, once productivity is streamlined. As the demand increases and territory expands, NOLA Brewing had no choice but to spread out, buying the adjacent warehouse and doubling its factory size. With that expansion, plans have also been set in motion for an adjoining brew pub or tap room to help further connect with customers in the next year or so.

But even as it grows, NOLA Brewing still relishes in the microbrewery scene, a highly collaborative community of small brewers spread out across the country sharing processes, recipes, and secrets with one another. ?The whole industry in itself is unique in that aspect. You don?t feel like you are competing against all these other craft breweries; you?re allies rather than enemies,? explains vice-president Dylan Lintern. ?It?s like the music industry: you?re not going to listen to the same band all the time and craft brew drinkers don?t drink the same beer all the time. They like to try different things,? Melanie adds. Craft beers companies only about comprise about 5% of the American beer market, the rest is still dominated by the ?big? companies Anheuser-Busch and Miller-Coors. But, NOLA Brewing is more than happy carving out their own little niche in the market, having fun making great beer, and re-establishing a great New Orleans tradition of homegrown beer.

As a perfect example of NOLA Brewing?s development and expansion, their newest creation ? Mechahopzilla Double IPA ? is finally set for release. The beer will be premiered at the Avenue Pub on Thursday, September 20 starting at 6pm upstairs. So come celebrate the new beer and all NOLA Brewing has to offer this week. World?s most powerful digital camera opens eye, records first images in hunt for dark energy

ScienceDaily (Sep. 17, 2012) ? Eight billion years ago, rays of light from distant galaxies began their long journey to Earth. That ancient starlight has now found its way to a mountaintop in Chile, where the newly-constructed Dark Energy Camera, the most powerful sky-mapping machine ever created, has captured and recorded it for the first time.

That light may hold within it the answer to one of the biggest mysteries in physics -- why the expansion of the universe is speeding up.

Scientists in the international Dark Energy Survey collaboration announced this week that the Dark Energy Camera, the product of eight years of planning and construction by scientists, engineers, and technicians on three continents, has achieved first light. The first pictures of the southern sky were taken by the 570-megapixel camera on Sept. 12.

"The achievement of first light through the Dark Energy Camera begins a significant new era in our exploration of the cosmic frontier," said James Siegrist, associate director of science for high energy physics with the U.S. Department of Energy. "The results of this survey will bring us closer to understanding the mystery of dark energy, and what it means for the universe."

The Dark Energy Camera was constructed at the U.S. Department of Energy's (DOE) Fermi National Accelerator Laboratory in Batavia, Illinois, and mounted on the Victor M. Blanco telescope at the National Science Foundation's Cerro Tololo Inter-American Observatory (CTIO) in Chile, which is the southern branch of the U.S. National Optical Astronomy Observatory (NOAO). With this device, roughly the size of a phone booth, astronomers and physicists will probe the mystery of dark energy, the force they believe is causing the universe to expand faster and faster.

"The Dark Energy Survey will help us understand why the expansion of the universe is accelerating, rather than slowing due to gravity," said Brenna Flaugher, project manager and scientist at Fermilab. "It is extremely satisfying to see the efforts of all the people involved in this project finally come together."

The Dark Energy Camera is the most powerful survey instrument of its kind, able to see light from over 100,000 galaxies up to 8 billion light years away in each snapshot. The camera's array of 62 charged-coupled devices has an unprecedented sensitivity to very red light, and along with the Blanco telescope's large light-gathering mirror (which spans 13 feet across), will allow scientists from around the world to pursue investigations ranging from studies of asteroids in our own Solar System to the understanding of the origins and the fate of the universe.

"We're very excited to bring the Dark Energy Camera online and make it available for the astronomical community through NOAO's open access telescope allocation," said Chris Smith, director of the Cerro-Tololo Inter-American Observatory. "With it, we provide astronomers from all over the world a powerful new tool to explore the outstanding questions of our time, perhaps the most pressing of which is the nature of dark energy."

Scientists in the Dark Energy Survey collaboration will use the new camera to carry out the largest galaxy survey ever undertaken, and will use that data to carry out four probes of dark energy, studying galaxy clusters, supernovae, the large-scale clumping of galaxies and weak gravitational lensing. This will be the first time all four of these methods will be possible in a single experiment.

The Dark Energy Survey is expected to begin in December, after the camera is fully tested, and will take advantage of the excellent atmospheric conditions in the Chilean Andes to deliver pictures with the sharpest resolution seen in such a wide-field astronomy survey. In just its first few nights of testing, the camera has already delivered images with excellent and nearly uniform spatial resolution.

Over five years, the survey will create detailed color images of one-eighth of the sky, or 5,000 square degrees, to discover and measure 300 million galaxies, 100,000 galaxy clusters and 4,000 supernovae.

The Dark Energy Survey is supported by funding from the U.S. Department of Energy; the National Science Foundation; funding agencies in the United Kingdom, Spain, Brazil, Germany and Switzerland; and the participating DES institutions.

A hot ticket, yes, but not an instant sell-out as in 2010, when Saul?s hosted a Referendum on the Jewish Deli Menu. ?We had star power then,? explained Karen Adelman. ?Michael Pollan. He?s a regular.? This year, they tried for Ruth Reichl. ?She really wanted to do it! Mark Bittman was interested, too ??

How bees decide what to be: Reversible 'epigenetic' marks linked to behavior patterns

ScienceDaily (Sep. 16, 2012) ? Johns Hopkins scientists report what is believed to be the first evidence that complex, reversible behavioral patterns in bees -- and presumably other animals -- are linked to reversible chemical tags on genes.

The scientists say what is most significant about the new study, described online September 16 in Nature Neuroscience, is that for the first time DNA methylation "tagging" has been linked to something at the behavioral level of a whole organism. On top of that, they say, the behavior in question, and its corresponding molecular changes, are reversible, which has important implications for human health.

According to Andy Feinberg, M.D., M.P.H., Gilman scholar, professor of molecular medicine and director of the Center for Epigenetics at Hopkins' Institute for Basic Biomedical Sciences, the addition of DNA methylation to genes has long been shown to play an important role in regulating gene activity in changing biological systems, like fate determination in stem cells or the creation of cancer cells. Curious about how epigenetics might contribute to behavior, he and his team studied a tried-and-true model of animal behavior: bees.

Working with bee expert Gro Amdam, Ph.D., associate professor of life sciences at Arizona State University and the Norwegian University of Life Sciences, Feinberg's epigenetics team found significant differences in DNA methylation patterns in bees that have identical genetic sequences but vastly different behavioral patterns.

Employing a method that allows the researchers to analyze the whole genome at once, dubbed CHARM (comprehensive high-throughput arrays for relative methylation), the team analyzed the location of DNA methylations in the brains of worker bees of two different "professions." All worker bees are female and, within a given hive, are all genetically identical sisters. However, they don't all do the same thing; some nurse and some forage.

Nurses are generally younger and remain in the hive to take care of the queen and her larvae. When nurses mature, they become foragers that leave the hive to gather pollen and other supplies for the hive. "Genes themselves weren't going to tell us what is responsible for the two types of behavior," Feinberg says. "But epigenetics -- and how it controls genes -- could."

Feinberg and Amdam started their experiment with new hives populated by bees of the same age. That removed the possibility that any differences they might find could be attributed to differences of age. "When young, age-matched bees enter a new hive, they divvy up their tasks so that the right proportion becomes nurses and foragers," explains Amdam. It is these two populations that were tested after painstakingly characterizing and marking each bee with its "professional," or behavioral, category.

Analyzing the patterns of DNA methylation in the brains of 21 nurses and 21 foragers, the team found 155 regions of DNA that had different tag patterns in the two types of bees. The genes associated with the methylation differences were mostly regulatory genes known to affect the status of other genes. "Gene sequences without these tags are like roads without stop lights -- gridlock," says Feinberg.

Once they knew differences existed, they could take the next step to determine if they were permanent. "When there are too few nurses, the foragers can step in and take their places, reverting to their former practices," says Amdam. The researchers used this strategy to see whether foraging bees would maintain their foraging genetic tags when forced to start acting like nurses again. So they removed all of the nurses from their hives and waited several weeks for the hive to restore balance.

That done, the team again looked for differences in DNA methylation patterns, this time between foragers that remained foragers and those that became nurses. One hundred and seven DNA regions showed different tags between the foragers and the reverted nurses, suggesting that the epigenetic marks were not permanent but reversible and connected to the bees' behavior and the facts of life in the hive.

Dramatically, Feinberg noted, more than half of those regions had already been identified among the 155 regions that change when nurses mature into foragers. These 57 regions are likely at the heart of the different behaviors exhibited by nurses and foragers, says Amdam. "It's like one of those pictures that portray two different images depending on your angle of view," she says. "The bee genome contains images of both nurses and foragers. The tags on the DNA give the brain its coordinates so that it knows what kind of behavior to project."

The researchers say they hope their results may begin to shed light on complex behavioral issues in humans, such as learning, memory, stress response and mood disorders, which all involve interactions between genetic and epigenetic components similar to those in the study. A person's underlying genetic sequence is acted upon by epigenetic tags, which may be affected by external cues to change in ways that create stable -- but reversible -- behavioral patterns.

Purpose of the rule or reason for the change:

This year the Legislature passed H.B. 29, Insurance Amendments, in the 2012 General Session. At the request of representatives from the Utah bail bond industry, the law was changed to eliminate the requirement for bail bond producers to take continuing education (CE) classes in order to renew their bail bond license. This rule is being amended to reflect this change in the law. The change in being made in large part because there were no bail bond CE classes available.

Summary of the rule or change:

Sections R590-142-1, R590-142-2, and R590-142-4 are being changed to eliminate the reference to Section 31A-35-401.5 of the code requiring bail bond agents to take continuing education to renew their license.

This rule is promulgated pursuant to:

(1) Subsection 31A-2-201(3) that authorizes the commissioner to adopt rules to implement the provisions of the Utah Insurance Code;

(2) Subsection 31A-23a-202(1) that authorizes the commissioner to adopt a rule to prescribe the continuation requirements for a producer and a consultant;

(3) Subsection 31A-23a-202(5) that authorizes the commissioner to adopt a rule to prescribe the processes and procedures for continuing education provider registration and course approval;

(4) Subsection 31A-26-206(1) that authorizes the commissioner to adopt a rule to prescribe the continuing education requirements for an adjuster; and

R590-142-2. Purpose and Scope.

(1) The purpose of this rule is to implement the continuing education requirements of Sections 31A-23a-202, 31A-26-206, and 31A-35-401.5.

(2) This rule applies to all continuing education providers and individual producer, consultant, and adjuster licensees under Sections 31A-23a-202, 31A-26-206, and 31A-30-209[, and 31A-35-401.5].

R590-142-4. Continuing Education Requirements.

A producer, consultant, and adjuster licensee shall comply with, and a continuing education provider shall be familiar with, the following continuing education requirements:

(1) the number of credit hours of continuing education insurance related instruction required to be completed biennially as a prerequisite to license renewal shall be in accordance with Sections 31A-23a-202, and 31A-26-206[, and 31A-35-401.5];

(2) a licensee may obtain continuing education credit hours at any time during the two-year licensing period;

(3) not more than half of the total credit hours required shall be satisfied by courses provided by insurers;

(4) upon renewal of a license, no continuing education credit hours in excess of the number required to renew the license may be carried over or applied to any subsequent licensing period;

(5) a licensee shall attend a course in its entirety in order to receive credit for the course;

(6) a licensee may repeat a course for credit but will not be permitted to take a course for credit more than once in a license continuation period;

(7) a nonresident licensee who satisfies the licensee's home state's continuing education requirement is considered to have satisfied Utah's continuing education requirement; and

(8) a licensee with a professional designation may use the continuing education credit hours required to maintain the designation to satisfy the requirement of the commissioner if:

(a) the hours are sufficient to meet the current continuing education requirement described in Sections 31A-23a-202 and 31A-26-206; and

(b) the professional designation consists of one or more of the following:

(i) Accredited Customer Service Representative (ACSR);

(ii) Accredited Financial Examiner (AFE) or Certified Financial Examiner (CFE);

(iii) Accredited Insurance Examiner (AIE) or Certified Insurance Examiner (CIE);

(iv) Certified Financial Planner (CFP);

(v) Certified Insurance Counselor (CIC);

(vi) Certified Risk Manager (CRM);

(vii) Registered Employee Benefits Consultant (REBC);

(viii) Chartered Property Casualty Underwriter (CPCU) with completion of the Continuing Professional Development (CPD) program; or

(ix) Certified Life Underwriter (CLU), Chartered Financial Consultant (ChFC) or Registered Health Underwriter (RHU) with completion of the Professional Achievement in Continuing Education (PACE) recertification program.

(9) A producer who solicits or sells a defined contribution plan in accordance with Section 31A-30-209 shall complete a minimum of two hours of defined contribution continuing education that includes training on use of the Utah Health Exchange and premium assistance programs:

(a) prior to soliciting or selling a defined contribution plan; and

(b) during each subsequent two-year licensing period that the producer solicits or sells a defined contribution plan.

Passage of New York soda ban disappoints restaurant industry ...

Association officials and restaurant operators expressed their frustration Thursday with the New York City Board of Health?s passage of a ban on the service of large sodas and sugary drinks.

The initiative, which was championed by Mayor Michael Bloomberg and designed to address the nation?s health and obesity problems, establishes a 16-ounce size limit on sodas or other sugary beverages served at restaurants, sports venues, movie theaters, street carts and delis.

Retail food and convenience stores ? which come under the jurisdiction of the state of New York ? are not regulated under the city ban.

According to the city, sugary drinks are defined as beverages that are ?sweetened with sugar or another caloric sweetener that contain more than 25 calories per 8 fluid ounces and contain less than 51 percent milk or milk substitute by volume as an ingredient. It does not apply to diet drinks, calorie-free drinks and alcoholic beverages.

The National Restaurant Association maintains its position that the ban ?unfairly targets restaurants, and is a misguided tactic to impact the obesity problem.?

?There is no scientific support that this beverage ban?s size and caloric limit will impact obesity rates,? said Joy Dubost, director of nutrition and healthy living for the NRA. ?It is also bewildering that the ban restricts restaurants from serving sweetened beverages in sizes larger than 16 ounces, but individuals can purchase any-sized beverage from a convenience or grocery store.

?This ban will punitively impact thousands of New York?s restaurant owners ? the majority of which are small businesses.?

International Franchise Association senior vice president of government relations and public policy Judith Thorman echoed that statement.

?This is an example of government overreach that unfairly targets restaurant franchises and is a misguided tactic to impact the obesity problem,? Thorman said. ?Mayor Bloomberg didn?t consult with the franchise industry, the restaurant industry or the beverage industry, and now this ban will be costly to franchisees who are already struggling to stay in business in a challenging economic environment. ?

The ban is expected to take effect in March 2013, and the city said earlier it will begin fining sellers by as much as $200 for violating the ban in mid-June.

Andrew Moesel, a spokesman for the New York State Restaurant Association, called the board?s passage of the ban ?disappointing but unsurprising." He noted, "After more than 38,000 residents shared their input, both positive and negative, the proposal passed almost entirely unchanged.?

The board passed the proposal by a vote of eight to zero, with one abstention.

Since introducing the proposal last May, Bloomberg has been a staunch supporter of the initiative. ?In New York City nearly 60 percent of adults and nearly 40 percent of children are overweight or obese, and there are real-world consequences,? he said earlier. ?People?s lives will be shorter, their quality of life is going to be dramatically reduced, and obesity is going to start killing more people in this country than smoking.?

According to the Centers for Disease Control and Prevention, obesity rates have risen steadily in the past few decades. In its most recent 2010 figures, the agency reported that 35.7 percent of U.S. adults and 17 percent of U.S. children between the ages of 2 and 17 are obese.

Dr. Michael Jacobson, executive director of the Center for Science in the Public Interest in Washington, D.C., called the ban ?an important innovative strategy for helping to promote health among New Yorkers. It?s unclear what the effect might be, but it?s an interesting experiment.?

Noting that some critics of the ban plan to challenge it in court, Jacobson added, ?If the measure takes effect, I think it will embolden other cities and states to become more aggressive in promoting health through serving size and other measures.?

Henrietta Davis, the mayor of Cambridge, Mass., already said she is considering a similar ban.

Opponents of the measure, however, called the proposal ?arbitrary? in its approach to limiting what people can and can?t eat. ?I don?t really get it,? said Irwin Kruger, the operator of two Smashburger outlets on Long Island, N.Y., and the former franchisee of seven McDonald?s outlets in New York. ?This [ban] puts restaurateurs [and other businesses] in a light that is unfair relative to the issues concerning health and nutrition. [A patron] in a theater won?t be able to buy a 16-ounce drink, but they can buy a dozen packs of M&Ms. [The city] is just picking on sugary drinks.?

Jamie Richardson, vice president of government and shareholder relations for White Castle, called the vote ?troubling but not surprising. It was not a decision made by elected officials ? [the city board of health is] all appointed. It doesn?t allow citizens in New York to have a voice. It just unilaterally tells people what they should have in terms of portion control.?

Richardson said White Castle, which operates 45 locations in New York City, hasn?t made a decision yet on how it will address the ban. "We will comply when we have to comply," he said. "We?ll try to look for our best options.?

White Castle offers drinks in three sizes ? 20 ounces, 32 ounces and 44 ounces.

?Soft drinks complement our menu,? he said. ?How do you provide the same level of guest satisfaction? It?s antithetical to consumer choice.

?At the end of the day, we run on razor-thin margins,? Richardson continued. ?In the best of times, this would be a bad idea. In tough times like this, it?s atrocious.?

Moesel said a number of ?gray areas? in the ban have yet to be hammered out by the city, including how consumers will be able to add sugar and syrups in coffee shops.

In the meantime, opponents say they will continue to fight the ban. Matthew Haller, vice president of public affairs for the International Franchise Association, said the IFA will continue its work to overturn the ban. "This just flat-out wrong and represents an overreach on the part of the mayor and the board of health,? he said.
